By accessing and using Simply Upscale ("we," "our," or "us"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our service.

2. Description of Service

Simply Upscale provides an AI-powered image upscaling service. We allow users to upload low-resolution images and enhance them utilizing advanced artificial intelligence models.

3. Data Collection and Usage

To provide our services, we collect and process certain types of data. Our practices are detailed below:

• Account Information: We collect and store your email address and a unique identifier to securely manage your account and authenticate your sessions.
• Payment Information: Payments are processed securely by Stripe. We do not store sensitive payment details (such as credit card numbers) on our servers; we only retain Customer IDs and Subscription statuses for billing and account access purposes.
• Usage Data: We store metadata related to your usage of the service, including your credit balances, upscale job settings (such as scale factor and creativity level), and operational timestamps.

4. User Content and AI Processing

When you use our service, you upload images ("User Content") for the purpose of upscaling.

• These images are temporarily stored in our secure cloud storage environment.
• To perform the upscaling, images are securely transmitted to our AI provider.
• Original and upscaled images are not kept indefinitely. They are automatically deleted from our servers following a predefined retention period (e.g., after 2 weeks for free users) via scheduled automated systems.

You retain all rights to your User Content. You are solely responsible for ensuring you have the necessary permissions and rights to upload and process any images through our service.

5. Subscriptions and Refund Policy

We offer premium subscriptions that provide additional upscaling credits and features. By subscribing, you agree to recurring billing as specified during the checkout process. You can cancel your subscription at any time. Upon cancellation, you will retain access to the premium service until the end of your current subscription period.

We do not offer refunds for any reason. Users are advised to consider their purchase carefully before subscribing.

6. Intellectual Property

The Simply Upscale website, its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7. Limitation of Liability

In no event shall Simply Upscale, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

8. Acceptable Use Policy

You are responsible for all your activity in connection with Simply Upscale. Make sure that you use our service in a manner that complies with the law. If your use of Simply Upscale is prohibited by applicable laws, then you aren't authorized to use the service. We can't and won't be responsible for you using Simply Upscale in a way that breaks the law.

You also agree that you will not use Simply Upscale in a manner that:

• Is fraudulent or threatening;
• Jeopardizes the security of your Simply Upscale account or anyone else's (such as allowing someone else to log into Simply Upscale as you, or sharing your account or password with someone);
• Attempts, in any manner, to obtain the password, account, or other security information of any other user;
• Violates the security of any computer network, or cracks any passwords or security encryption codes;
• Decompiles, reverse engineers, or otherwise attempts to obtain the source code or underlying ideas or information of or relating to Simply Upscale.

9. Responsibilities

Simply Upscale is not responsible for what the user does with the user-generated and AI-generated content produced through our services.

10. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any significant changes by updating the "Last Updated" date at the top of this page. Your continued use of the service following any changes constitutes your acceptance of the new Terms.
